1. Overview

Mighty Nimble is an AI-powered fitness app that generates personalized exercise routines based on your goals, fitness level, and preferences. By using the Mighty Nimble app or website, you agree to these terms. If you do not agree, please do not use the service.

2. Account

You create an account using one of our supported sign-in methods. You are responsible for maintaining access to your account and for all activity that occurs under it. You must be at least 13 years old to use Mighty Nimble.

3. Acceptable Use

You may use Mighty Nimble for personal, non-commercial fitness purposes. You agree not to misuse the service, attempt to access it through unauthorized means, or use it in any way that could harm the service or other users.

4. Intellectual Property

Routines generated for you are yours to use for personal purposes. Exercise illustrations, the Mighty Nimble brand, and all other visual and functional elements of the service remain the property of Mighty Nimble and may not be reproduced or redistributed.

5. Assumption of Risk & Fitness Disclaimer

Mighty Nimble uses artificial intelligence to generate personalized fitness routines. These routines are provided for informational and educational purposes only and do not constitute medical advice or a substitute for professional guidance from a qualified healthcare provider or certified fitness professional.

By using Mighty Nimble, you acknowledge and agree that:

• Physical exercise carries inherent risks of injury.
• You are solely responsible for determining whether any exercise is appropriate for your physical condition.
• You should consult a physician before starting any new exercise program, particularly if you have existing health conditions.
• You should discontinue any exercise that causes pain or discomfort.
• AI-generated content may not account for all individual factors affecting your safety.

To the maximum extent permitted by applicable law, Mighty Nimble and its owners shall not be held liable for any injury, loss, or damage arising from your use of the app or any routine, exercise, or recommendation provided through it.

6. Limitation of Liability

Mighty Nimble is provided “as is” without warranties of any kind, express or implied. We do not guarantee that routines will be error-free, uninterrupted, or suitable for any particular purpose. In no event shall Mighty Nimble or its owners be liable for indirect, incidental, special, or consequential damages arising from your use of the service.

7. Subscriptions & Billing

Mighty Nimble offers optional auto-renewable subscriptions (“Mighty Nimble Plus”) that unlock additional features. Subscriptions are billed through your Apple ID account.

• Free trial: Some subscription plans include a free trial period. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription and your Apple ID account will be charged the subscription price.
• Renewal: Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period.
• Cancellation: You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
• Price changes: Subscription prices may change. If the price increases, you will be notified in advance and must agree to the new price to continue your subscription.

Payment is processed by Apple. Mighty Nimble does not collect or store your payment information. See Apple's Licensed Application End User License Agreement for additional terms.

8. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these terms. You may delete your account at any time through the app.

9. Changes to Terms

We may update these terms from time to time. If we make material changes, we will update the date at the top of this page. Your continued use of Mighty Nimble after changes are posted constitutes acceptance of the revised terms.

1. Information We Collect

When you use Mighty Nimble, we may collect the following information:

• Account information provided when you sign in, such as your name and email address.
• Profile data you choose to provide, such as fitness level, goals, health conditions, and additional details about your needs.
• Workout history, including completed routines, exercise stats, and progress data.
• Device tokens for push notifications, if you enable them.
• Usage data, including app interactions and session information, collected through analytics tools.
• Email address, if you submit it through our website.

2. How We Use Your Information

• Generate personalized routines — your fitness profile and prompts are used by our AI to create routines tailored to your needs.
• Send notifications — we use push notifications to inform you when routines are ready or updated.
• Improve the service — analytics help us understand how the app is used and where to improve.
• Communicate with you — if you provide your email, we may send relevant updates. You can unsubscribe at any time.

3. Third-Party Services

We use trusted third-party services to operate Mighty Nimble, including:

• Authentication providers to manage your account and sign-in.
• AI and machine learning to generate personalized routines and exercise illustrations. Your fitness profile information (such as fitness level, goals, and health conditions) is used to personalize your experience.
• Analytics services to understand how the app is used and improve the experience. Text inputs are masked in any session recordings.
• Email services to send communications and updates.
• Cloud infrastructure for data storage, hosting, and push notification delivery.
• Monitoring services for application performance and error tracking.

Each of these services has its own privacy policy governing how they handle data.

4. Data Storage & Security

Your data is stored on Amazon Web Services in the United States. All data is encrypted in transit using HTTPS and at rest using AWS encryption standards. We implement reasonable security measures to protect your information, but no method of electronic storage is 100% secure.

5. Data Retention

We retain your account data for as long as your account is active. Workout history is retained to support your progress tracking. Published routines (shared via link) are retained even if the source routine is deleted. If you delete your account, we will remove your personal data from our active systems, though some information may persist in backups or third-party service logs.

6. Your Rights

You may request deletion of your personal data at any time by contacting us at support@mightynimble.ai. You can delete your account through the app. You can unsubscribe from email communications at any time using the link provided in each email.

7. Children's Privacy

Mighty Nimble is not intended for children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will promptly delete it.

8. Changes to This Policy

We may update this privacy policy from time to time. Changes will be reflected by an updated date at the top of this page.
